Health Groups Oppose Medical Record Access Rule

Some 20 medical groups are opposing a proposed rule by the U.S. Department of Health and Human Services (HHS) to give patients the right to see who has looked at their health information in the past three years, according to MedPageToday.com.

Right now, the Health Insurance Portability and Accountability Act requires health-care providers, or anyone else with access to protected health information, to track who looks at an individual patient’s files. But that information doesn’t have to be shared.

Among the groups opposing the rule are the American Medical Association, the American College of Cardiology, the American College of Physicians, and the Medical Group Management Association. In a letter to HHS, they argued that the rules would be costly and hard to implement.

HHS proposed the rule to increase provider accountability. If passed, it would modify the Health Information Technology for Economic and Clinical Health Act of 2009 that governs electronic medical records. It would go into effect in 2013.

Public comment on the ruling has closed and the agency will make a final decision later this year.
